1. Acceptance of Terms

By accessing and using Public Nook ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Public Nook is a social platform that connects residents with their local communities based on ZIP codes. The Service allows users to discover neighborhoods, connect with neighbors, interact with local HOAs, view vendor advertisements, and provide business recommendations.

3. User Accounts and Registration

To access certain features of the Service, you may be required to register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and update your information to keep it accurate and current
  • Maintain the security of your password and account
  • Notify us immediately of any unauthorized use of your account
  • Be responsible for all activities that occur under your account

4. User Roles and Responsibilities

The Service supports different user roles including regular users, vendors, HOA administrators, and community administrators. Each role has specific privileges and responsibilities:

  • Users: Can view communities, connect with neighbors, and post reviews
  • Vendors: Can create business listings and post advertisements
  • HOA Administrators: Can manage HOA information and communicate with residents
  • Community Administrators: Can moderate community message boards and manage community information

5. User Conduct

You agree not to use the Service to:

  • Post false, inaccurate, misleading, or defamatory content
  • Harass, threaten, or intimidate other users
  • Violate any local, state, national, or international law
  • Impersonate any person or entity
  • Post spam or unauthorized commercial communications
  • Collect or store personal data about other users without permission
  • Interfere with or disrupt the Service or servers

6. Content and Intellectual Property

You retain ownership of content you post on the Service. By posting content, you grant Public Nook a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content in connection with the Service.

All Service content, features, and functionality (including but not limited to text, graphics, logos, and software) are owned by Public Nook and are protected by copyright, trademark, and other intellectual property laws.

7. Vendor Advertisements and Recommendations

Vendors may post advertisements for their businesses. Public Nook does not endorse, verify, or guarantee any vendor services or products. Users post recommendations and ratings at their own discretion, and these represent individual opinions only.

8. Community Message Boards

Community message boards are intended for residents to communicate about local issues and events. Community administrators have the right to moderate content to ensure compliance with these Terms of Service.

9. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our practices.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. Public Nook disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

Public Nook shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use or inability to use the Service.

12. Modifications to Service and Terms

We reserve the right to modify or discontinue the Service at any time without notice. We may also update these Terms of Service from time to time. Continued use of the Service after changes constitutes acceptance of the modified terms.

13. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms of Service.
